What happened
On 6 August 2026 the Home Office added a correction slip to the statutory guidance for the Terrorism (Protection of Premises) Act 2025, and on 7 August published a PDF version of the guidance with the correction included.
The most important change concerns tenanted pubs. The original example suggested the brewery or pub company would be responsible. The corrected guidance makes clear that the tenant who is in control of the premises is the responsible person. Control, not ownership or holding the premises licence, is the test.
The correction slip also confirms the wording used for the Recognise, Assess, React approach in the guidance.
What to do now
- Tenants and lessees: assume you are the responsible person if you run the premises day to day, and plan accordingly.
- Pub companies and landlords: tell your tenants, and agree in writing how you will cooperate.
- Use the corrected PDF, not older downloads, when you check the guidance.
